Who determined that this plat conforms to the Zoning Code — and when?
A name or an office. A date. The document it is written in.
If there is no answer, and no one who made it, then the authority was bypassed.
Under Ordinance §410.010(I), a plat must conform to the Zoning Code before it is approved. If no conformity determination exists, the Commission must deny the action before it tonight.
Why no one can answer it
The measurements could not take place on a lot that does not exist. Open storage at 40%, coverage at 75%, setbacks, height, screening, the property line that dust and noise are measured at — every one of them is measured against a lot.
This plat is what creates the lot. So conformity could not have happened. There was nothing to measure.
And if it is approved anyway — how do we appeal?
The Board of Adjustment hears appeals from a decision made by a City official enforcing the Zoning Code. Until someone is named, there is no decision to appeal — which is exactly what the City told residents in July: no determination had been made, so there was nothing to review.
That is why the name and the date have to be said out loud, tonight, and written in the minutes.
