Dear Abbie,

Enclosed for filing and distribution is Petition 4 — Request to Deny the Consolidation and Boundary Adjustment, submitted on behalf of the petitioners for the Planning and Zoning Commission’s meeting of September 21, 2026.

Please distribute it to the Chairman and members of the Commission, the Mayor, the Board of Aldermen, the City Attorney, the Zoning Officer, and the Building/Permits Official, and enter it in the record of the meeting, as you did with the July 20 filing.

The request in one paragraph
The petitioners ask the Commission to deny the consolidation and boundary adjustment, or in the alternative to table it until three things are in the file: written confirmation that the open items in the Building Inspector’s July 15, 2026 §410.010(G) review have been closed; a plat or site plan that shows and dimensions the aggregate storage area, together with a legal description fixing the boundary of the approved operating area; and the fire and fuel-storage review, the final traffic study, and the final stormwater review that the City’s own records show have not been completed.

The basis is set out in the petition and rests on records the City produced, on the applicant’s own filings with the Missouri Department of Natural Resources, and on the plan sheets themselves. In short: the aggregate storage area was labeled on the June 13, 2025 set at 33 acres, grew to 36.4 acres on the set the Board approved, and does not appear at all on the July 8, 2026 set now associated with this consolidation — while Condition 3 of the June 11, 2026 approval withholds approval of any storage area “on the note on Lot 5 or otherwise.” The plant block reads “About 5 Acres,” no legal description fixes its boundary, and the City confirmed on August 6, 2026 that it holds no 40% open-storage calculation and no 75% building-coverage calculation.

A written response is requested within fourteen days. A written refusal stating grounds is accepted as a complete response.
