Request to deny the consolidation — the conformity question
Section 410.010(I) requires a plat reviewed under Chapter 410 to conform to the Zoning Code before record-plat approval. Petition 4 asks which plan, which measurements, and whose determination establish that conformity, and asks the Commission to deny the consolidation if no such determination exists.

No body has replied to any of them
No substantive answer, no referral, no declination, no statement of position, and not the written statement of non-response the July 31 filing invited. No reason has been given for the silence. For two of the filings the Clerk confirmed in writing that the petition had been forwarded to the officials it was addressed to and filed for the record. That is confirmation it arrived, not that anyone acted on it.

The Board of Adjustment route, attempted and closed
Residents pursued the administrative route the Council itself had suggested. Community members asked on several occasions for the applications needed to begin a Board of Adjustment proceeding, and were
denied each time. The City’s written position is here:

Community members filed anyway, on July 10, 2026, within the thirty-day deadline running from the June 11 decision. Some received acknowledgment that their filing had been received; others received nothing. The filings were not forwarded to the Board of Adjustment. On July 16, 2026 the City declined to accept or docket them, stating that no administrative zoning determination had been made that was subject to Board of Adjustment review.
That answer is why the September 21 plat matters. If no administrative zoning determination had been made as of July 16, then the conformity ยง410.010(I) requires had not been determined by anyone — and Condition 2 of the June 11 approval makes this plat the act that approval depends on.
