This volume is the documentary record supporting Volumes I and II. Exhibits A through M were filed with Petition 3 on August 17, 2026 and are carried forward unchanged. Exhibits N through R are records produced, received, or created since that date and are new to this filing. Every item is a public record: produced by the City under Chapter 610 RSMo, filed by the applicant with the State of Missouri, or recorded with Warren County.

What this record establishes
The civil plans changed materially three times. The Commission reviewed and voted on only one plan set, dated June 13, 2025. The aggregate-storage area was labeled at 33 acres on that set, 36.4 acres on the January 29, 2026 set the Board approved, and is not depicted in the same manner on the July 8, 2026 set now before the Commission. No record has been located of a Commission review or recommendation on either later set. The City has stated in writing that it holds no open-storage or building-coverage calculation, no desirability review, and no document fixing the plant’s location and setbacks. No administrative zoning determination has been identified.

Q City Clerk’s fee emails of June 10, 2026 assessing $11,600 on approximately 58 acres, with Sheet C-2’s “Total Project Area: 58 Acres” and its stormwater summary. That the project was billed as a 58-acre development the day before an approval covering about five acres that excludes the storage area.
R BFA Engineering letters of February 10, 2026 and the Clerk’s forwarded BFA email of August 28, 2026; CBB technical memorandum of May 20, 2026, invoice 260280001 at 75% complete, and check #57075. That the stormwater review was prepared against the superseded five-lot plan and that no final construction plans or final traffic study exist.

No substantive response has been received to any of them. The City’s reply of July 20, 2026 at 8:57 AM confirmed that the filing had been forwarded to the City Attorney, the Mayor, the Board of Aldermen, the Planning and Zoning Commission, the Zoning Officer, the Building/Permits Official “and any other official responsible for this matter” and “filed for the record.” That is a confirmation of distribution, not a decision.
